General Terms and Conditions of Spitzmüller AG

§1 Validity vis-à-vis entrepreneurs and definitions of terms

(1) The following General Terms and Conditions of Business apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB).

§2 Conclusion of a contract, storage of the contract text

(1) The following provisions on the conclusion of contracts apply to orders placed via our online store https://www.spitzmueller.de/ .

(3) The presentation of the goods in our online store does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

Before submitting the binding order, the consumer can return to the website on which the customer's details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the "Back" button contained in the Internet browser used by him after checking his details. We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept your offer.

(5) Storage of the contract text for orders via our Internet store: We will send you the order data and our GTC by e-mail. You can also view the GTC at any time at https://www.spitzmueller.de/agb. For security reasons, your order data is no longer accessible via the Internet.

§3 Prices, payment, due date

(1) The prices quoted include statutory VAT and other price components.

(2) The consumer has the option of payment in advance, PayPal, credit card (Visa, Mastercard).

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

§4 Retention of title

We reserve title to the goods until the purchase price has been paid in full.

Consumers are entitled to a right of revocation in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity:

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must send us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

If you have requested that the services should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

§7 Cancellation

Each registration will be confirmed in writing by Spitzmüller AG. With your registration you accept our conditions of participation. Participation in the event requires payment of the invoice. If you cancel in writing up to 10 days before the event (receipt by us), you will not incur any costs. If you cancel up to the day before the event, 25% of the participation fee must be paid. If you cancel at a later date, the full price will be charged. Of course, you are welcome to name a substitute participant. Name badges, which will be handed out before the start of the event, serve as proof of participation.

§8 Warranty

The statutory warranty regulations apply.

§9 Contract language

The contract language is exclusively German.
